These Terms of Service ("Terms") govern use of the OLWeather Android application and the OLWeather website at olweather.com. By using OLWeather, you agree to these Terms. If you do not agree, do not use the app or website.

Weather and planning information

OLWeather presents weather forecasts, official warnings, alerts, scores, suggested time windows, regional context, activities, and planning guidance derived from third-party data and app or website calculations. Forecasts, alerts, scores, and recommendations may be delayed, incomplete, unavailable, or inaccurate.

Locations and permissions

You are responsible for checking that the selected location is correct. Location, notification, alarm, and background permissions are optional, but related features may be limited if permission is denied or restricted by Android, your device manufacturer, or your browser.

Official alerts

Where supported, OLWeather may display official alerts from providers such as NDMA SACHET (India), MET Norway, or NOAA / the National Weather Service (United States). Delivery is not guaranteed, and an official alert reflects only what the issuing authority's feed returned at the time of the request. Always use official local warning systems during hazardous conditions.

Places, activities, and nearby attractions

OLWeather may display factual place names, categories, activities, and independently written summaries. OLWeather is not affiliated with or endorsed by listed venues unless expressly stated. Opening hours, prices, access, events, transport, accessibility, and safety conditions can change. Confirm unverified information locally before visiting or relying on it.

Place names and categories are factual references and do not claim ownership, sponsorship, partnership, or endorsement. Third-party names and trademarks belong to their respective owners.

Advertising

The free version of the app may display AppLovin advertising. The website may display Adsterra advertising, shown only in dedicated regions of the page, never inside forecast, warning, or planning content.

Premium subscription

OLWeather Premium is an auto-renewing yearly subscription processed by Google Play. Google Play controls payment processing, renewal, cancellation, and refunds under its applicable rules. Premium removes in-app advertising, unlocks additional home-screen widgets, and increases the number of locations you can save, as described at the time of purchase; it does not guarantee continuous availability of weather providers or network services.

The free version allows saving up to a stated number of locations; Premium allows saving up to a higher stated number. Current limits are shown in the app.

Where OLWeather offers a limited-time introductory price (for example, a lower price for an initial number of years for subscribers who purchase within a stated launch window), that introductory price applies for the stated number of billing periods as disclosed at the time of purchase, after which the subscription renews at the then-current regular price unless cancelled. OLWeather will honor the introductory term disclosed to you at purchase for its full stated duration.

OLWeather may introduce new subscription tiers, change the regular subscription price, or change which features are included in Premium, for future purchases and future renewal terms. Any such change to an active subscriber's price will only take effect consistent with Google Play's required advance-notice process for subscription price changes, which gives you the opportunity to review the new price before it applies and to cancel if you do not accept it.

Third-party services and content

OLWeather relies on third-party weather, alert, geographic, environmental, advertising, and billing services (see the Privacy Policy for the full list). Their content, availability, privacy practices, licences, and terms are controlled by those providers. Provider outages, rate limits, network restrictions, or data changes may affect the app or website.

Icons: OLWeather uses Phosphor Icons under the MIT licence, together with OLWeather's own proprietary artwork. The licence notices are on the Icon licences page.

Acceptable use

You must use OLWeather lawfully. You must not misuse, disrupt, reverse engineer except where applicable law expressly permits it, interfere with security, impersonate an official weather or emergency service, or use OLWeather to create false or misleading emergency communications.

Intellectual property

OLWeather's original software, visual design, branding, and independently written content are protected by applicable intellectual-property laws. Third-party weather data, geographic data, venue names, trademarks, and other provider content remain subject to their respective rights, licences, and attribution requirements.

Availability and changes

OLWeather may change, suspend, or discontinue features because of maintenance, provider changes, legal requirements, security concerns, operating-system restrictions, or product updates. We do not guarantee uninterrupted or error-free operation.

Disclaimer

To the maximum extent permitted by applicable law, OLWeather is provided "as is" and "as available," without warranties of accuracy, availability, fitness for a particular purpose, or non-infringement. Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

OLWeather is not insurance, a risk-transfer product, or a guarantee against loss of any kind, and does not assess, underwrite, or compensate for weather-related risk. Any decision you make based on information in the app or on the website — including travel, agricultural, construction, business, event, property, or personal decisions — is made at your own discretion and risk.

Limitation of liability

To the maximum extent permitted by applicable law, OLWeather and its developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, data, goodwill, crops, livestock, property, or other financial loss, arising from or related to your use of, inability to use, or reliance on the app, website, forecasts, official alerts, scores, recommendations, place information, or any third-party service, even if OLWeather has been advised of the possibility of such loss.

To the extent any liability cannot be excluded under applicable law, OLWeather's total aggregate liability to you for all claims arising from your use of the app or website will not exceed the amount you paid to OLWeather in the 12 months before the claim arose, or the Indian Rupee equivalent of USD 10, whichever is greater. Mandatory consumer-protection rights that cannot lawfully be limited or excluded remain unaffected by this section.

Eligibility

You must be able to form a legally binding contract to use OLWeather. If you are under the age at which you can legally agree to these Terms in your country, you may only use OLWeather with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.

Force majeure

OLWeather will not be liable for any failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, severe weather events, pandemic or public health emergency, war, terrorism, civil unrest, government action or regulation, labour disputes, internet or telecommunications failure, power outages, or failure or unavailability of any third-party provider, hosting infrastructure, or app-store platform that OLWeather depends on.

Termination

You may stop using OLWeather at any time by uninstalling the app or ceasing to use the website. OLWeather may suspend or terminate your access to the app or website, without notice, if you violate these Terms, misuse the service, or engage in conduct OLWeather reasonably believes is harmful to OLWeather, other users, or third parties. Sections of these Terms that by their nature should survive termination (including Disclaimer, Limitation of liability, and Governing law) will survive.

Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws principles, except where applicable local consumer-protection law in your own country grants you rights that cannot be waived or overridden by this clause — those rights remain available to you regardless of this section.

If a dispute arises, you agree to first contact OLWeather at olweather.app@gmail.com and attempt to resolve it informally before pursuing a formal claim. Subject to any non-waivable local consumer rights, any dispute not resolved informally will be subject to the exclusive jurisdiction of the courts of India.

Severability

If any provision of these Terms is found unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No waiver

OLWeather's failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing to be effective.

Assignment

OLWeather may assign or transfer these Terms and its rights and obligations under them, including in connection with a merger, acquisition, or sale of assets, without your consent. You may not assign or transfer these Terms without OLWeather's prior written consent.

Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and OLWeather regarding your use of the app and website, and supersede any prior agreements or communications on that subject.

Changes to these Terms

We may update these Terms when the app, website, providers, or legal requirements change. The "Last updated" date identifies the latest version. Continued use after an update means you accept the revised Terms to the extent permitted by law.
